By registering for these Services (as defined below) offered by Paisabazaar Marketing and Consulting Private Limited ("Paisabazaar/we/us") through its website www.paisabazaar.com (“Website”) and Mobile App (collectively “Platform”) you are agreeing to be bound by these Terms of Service, and all applicable laws and regulations. By accepting electronically (for example, clicking "Pay Now” or “Submit” or “Try For Free”), accessing or using the Services, you agree to abide by these terms. These are add-on Services of Paisabazaar Credit Score Service and you understand and acknowledge that these terms of service have to be read in conjunction with the Paisabazaar Credit Report Terms of Use and Paisabazaar Terms of Use. The Terms of Use and Privacy Policy of the Platform shall also govern these Services. These Terms of Service contain important information regarding the Services that Paisabazaar will provide to you for the Credit Health Report Services and you shall read it carefully before accepting them. By way of using this Platform, it shall be deemed to constitute sufficient proof that you have read and understood these Terms of Service and disclaimers set out herein. If you do not agree to these Terms of Services as a whole, then you must not proceed to use the Services provided on the Platform.
“Services” shall mean to include Credit Health Report Services in name of “Credit Pro” or “Credit Health Report”
Credit Health Report Services
Credit Health report is a self-explanatory service to assist you in understanding your credit report. Paisabazaar will also provide an expert/agents advisory to assist you in resolving any questions at an additional service fee. The expert/advisory call shall advise solely in connection with your credit information/score/report. You agree that an advisory expert of Paisabazaar shall help you to understand your credit health report including the different types of information which is contained in your credit health report. This Credit Pro Service will also include analyzing and helping you understand the various parameters/factors influencing your credit health.
You can avail the Credit Pro / Credit Health Report Services in lieu of a fee. which shall be charged by Paisabazaar at its sole discretion. Paisabazaar reserves the right to determine such charges/fees and any changes therein from time to time without any prior notice. Further, all charges quoted to you shall be exclusive of any applicable taxes for which you shall be additionally charged at the applicable rate of taxes from time to time.
Credit Health Report Services Subscription Agreement Terms
This Subscription Agreement (this “Agreement”) contains terms and conditions that govern your acquisition of subscriptions to, and use of, the Services (as defined below), and becomes a binding contract between Paisabazaar and you - :
(1) when you access or use the Free-Trial Services or the Subscription services, as applicable, or
(2) when you click an “continue” or similar button referencing this Agreement; whichever is earlier
Term of the Free Trial- For Services where Free Trial is available, Trial period will be for thirty (30) days from the date you activate the Trial. At the end of the Trial period, if you start a paid subscription, you agree to pay us the applicable fees and taxes and also agree to the additional terms specific to the paid Services. Failure to pay the subscription fees will result in the immediate termination of your paid Services. Term of the Subscription- If you start a paid subscription without a Free Trial, you agree to pay us the applicable fees and taxes and also agree to the additional terms specific to the paid Services. Failure to pay the subscription fees will result in the immediate termination of your paid Services. Also, for both Term of the Subscription and Term of the Free Trial you agree that:
1. If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period.
2. To avoid any future charges, you can cancel a subscription anytime before the renewal date. To cancel your Credit Health Report Subscription or update your payment mandate details, Log in to paisabazaar website and visit your credit health dashboard to exercise the aforesaid options.
3. All of your purchases of Services are subject to Paisbazaar’s refund policy.
4. You agree that Paisabazaar at its sole discretion may decide to provide or not provide a paid subscription or free trial.
5. You agree that Paisabazaar reserves the right to stop the Free Trial without any notice and without assigning any reason at anytime.
Recurring Payments
Paisabazaar may make available an option to customers to make payments on a recurring basis ("Recurring Payments") in respect of the subscription that is offered by Paisabazaar.
Paisabazaar may, at any time, without any notice to you, discontinue offering Recurring Payments for the subscription.
You may choose, but will not be bound, to avail Recurring Payments for the payments towards your subscription.
Eligible Payment Methods
You can opt for Recurring Payments only in the event a payment method selected by you for the purpose of Recurring Payments is current, valid and acceptable (for the purpose) to us. Such method is hereinafter referred to as "Payment Method".
We reserve the right to decide the Payment Methods eligible for Recurring Payments. We may also choose to extend the Recurring Payments to selected Payment Methods / products offered by a bank. In other words, our recognition of a specific Payment Method / product offered by a particular bank would not imply our recognition of other Payment Methods / products offered by such bank.
Paisabazaar may provide you with the option to change your Payment Method for payment of subscription fees using Recurring Payments, provided however such Payment Method is eligible for Recurring Payments. In the event the option is made available by Paisabazaar and in case of such change, to activate Recurring Payments through such a new Payment Method, you will need to enable Recurring Payments on such new Payment Method.
You are solely responsible for the accuracy of the information about the Payment Method provided by you, including without limitation, card (credit / debit) details.
Enable Recurring Payment
We may offer you the ability to enable Recurring Payments at the time you initiate, renew or otherwise make payments towards the subscription.
If you proceed with the Recurring Payments option, your subscription will auto renew for such subscription period(s) given at the Platform and you will be charged automatically for the subscription fees, through the Payment Method registered by you for Recurring Payments, on the last day of each subscription period. For avoidance of any doubt, it is clarified that auto renewal will be effective upon the expiry of your then current subscription period.
Your subscription may begin with a Free Trial or promotional period of 30 days , if you choose to opt for and enable Recurring Payments for your Membership for payments of subscription fees on expiry of such period. Under such Free Trial or promotional period, you may not be required to pay any subscription fees.
Before Recurring Payments is effected for your subscription, a token amount may be charged on the Payment Method proposed to be used by you (for Recurring Payments), for verification / authentication purposes. Once the verification / authentication is successful, you will be registered for Recurring Payments and the token amount charged will be refunded to you.
You agree, understand and acknowledge that Paisabazaar may engage third party payment processors / gateway service providers to facilitate processing of Recurring Payments. Accordingly, you may be required to follow / adhere to any terms and conditions of such third party payment processors / gateway service providers, as communicated to you, from time to time.
You grant permission to Paisabazaar to collect and forward your mandate instructions to Paytm. You understand this information may be stored with Paytm & will be shared with NPCI for efficient payment processing. This consent ensures a hassle-free experience in managing your payments.
Subscription
Subscription will be made available to you, upon payment being charged to your Payment Method.
Once Recurring Payments has been enabled for your subscription, you authorize us or the third party through which you transact to charge the subscription fees for the next subscription period(s) during the subsistence of your subscription, unless you cancel or disable Recurring Payment, by means specified by us or the third party through which you transacted and applicable at such time. In this case your subscription will not renew automatically.
In case you cancel your subscription before the end of the then current subscription period, you will not be entitled to any compensation, monetary or otherwise, from Paisabazaar and/or its affiliates for the unutilized subscription period.. The amount of subscription fees shall be governed by the terms of the subscription, and you acknowledge that the same is subject to change from time to time at sole discretion of Paisabazaar without any prior notice.
Force Majeure
The subscription shall be subject to force majeure events and on occurrence of such an event, the Free Trail may be withdrawn at the discretion of Paisabazaar.
Disable / Cancel Recurring Payments
You may cancel or disable Recurring Payments for your subscription either in the settings / preferences of your Paisabazaar account. For avoidance of any doubt, it is clarified that if you cancel or disable Recurring Payments or auto renewal of your subscription, your on-going subscription will continue for the remainder of the subscription period, however in the event you cancel or disable Recurring Payments during the Free Trial or promotional period, any unavailed period shall lapse and will not be available to you.
In case one of your Recurring Payments is declined for any reason whatsoever, including expiry of your card (credit / debit), we may cancel your subscription, unless you provide us with a new mandate. If you provide us with a new mandate and are successfully charged before your subscription is cancelled, your new subscription period will be based on the original renewal date and not the date of the successful charge.
Notification and Communication
You authorize us to communicate with you through emails in connection with your subscription and/or Recurring Payments. You acknowledge that we may also communicate with you through our affiliate(s) providing the subscription or the benefits of the subscription to you.
Chatbot
By continuing to use our chatbot, you understand that:
1. This [chatbot] (can use the designated name of the chatbot, if any) provides automated responses generated by a machine-learning algorithm and relies on the accuracy of the underlying Language Models (currently OpenAI’s GPT - [4]). Our research is an ongoing process, and while we strive to provide accurate and relevant information, we cannot guarantee the accuracy or completeness of the responses produced by the [chatbot]. We recommend that you use the generated responses as a starting point and verify the information with the associated sources.
2. The Paisabot retains logs of these conversations and may be reviewed by our content team to improve results. Any stored data is held by us in compliance with our Privacy Policy. Do not share any sensitive or personal information like your name, PAN card, etc. in your conversations.
3. You shall not input any unlawful or illegitimate information on the [chatbot], as the same may result in disabling account access and/or removal of such information.
Disclaimer of Liability
You shall not hold Paisabazaar, its group entities, or affiliates, their respective directors, officers, employees, agents, vendors responsible for any losses or damages suffered by you on account of your use of Recurring Payments for the subscription, including as a result of any fraud in connection with any payment of Membership fee using your Payment Method.You further agree to indemnify, defend and keep Paisabazaar harmless against all damages, liabilities, costs, expenses,claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Paisabazaar as a consequence of violations of these terms and conditions by you, violation of applicable laws, any action or inaction resulting in wilful misconduct or negligence on your part.
